§ 39.4     11 U.S.C. § 1302: Powers and Duties of Trustee

Section 1302 is the basic source for all the trustee’s powers and duties in a Chapter 13 case. By reference to other sections of the Code, the Chapter 13 trustee has many duties of a trustee in a Chapter 7 or Chapter 11 case, but the Chapter 13 trustee’s power to deal with estate property is significantly limited. The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA)1 added to § 1302 difficult new trustee duties with respect to noticing the holders of domestic support obligations.2
