Part 3 deals with the busy period between the filing of the petition and confirmation of the Chapter 13 plan. The debtor has many powers and responsibilities during this time, including attendance at the meeting of creditors, commencement of payments, control of estate property and recovery of prepetition transfers. The trustee’s powers and duties are also discussed in this part of the book, with emphasis on the interaction between the trustee and attorneys representing debtors and creditors. Representing creditors prior to confirmation includes requesting relief from the stay and the codebtor stay. Construction of the Chapter 13 plan is discussed in Part 4.
