§ 155.6 Bankruptcy Rule 4008: Discharge Hearing

The bankruptcy court is permitted but not required to schedule a discharge hearing within 30 days following the entry of an order granting or denying discharge in a Chapter 13 case. After the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA),1 if § 522(q) applies,2 a hearing may be required prior to entry of discharge.3
