§ 130.9     Bankruptcy Rule 3004: Filing of Claims by Debtor or Trustee

After many years of inaccurately reflecting § 501,1 Bankruptcy Rule 3004 was amended in 2005 to permit the debtor or the Chapter 13 trustee to file a proof of claim on behalf of a creditor that has failed to file its own timely proof of claim. The debtor or the trustee has 30 days after expiration of the 90-day and 180-day periods fixed in Bankruptcy Rule 3002(c) within which to file a claim on behalf of a creditor. After the 2005 changes to Rule 3004, there is no provision for the creditor to then file a superseding claim.2
