Chapter 13 debtors sometimes just disappear. When contact with the debtor completely fails, counsel must consider seeking to withdraw.
Local practice varies whether debtor’s counsel will be permitted to withdraw upon a showing that the debtor is not to be found. In some jurisdictions, judges require counsel to remain in the case until the case can be noticed for conversion or dismissal. There are often local rules describing the procedure an attorney must follow to withdraw as debtor’s counsel.
