§ 39.21 — Bankruptcy Rule 4002: Duties of Debtor

Bankruptcy Rule 4002 requires the debtor to cooperate with the trustee, to examine proofs of claim and to file a statement of any change of address. As amended in 2008—in part to implement the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA)1—Rule 4002(b) requires Chapter 13 debtors to bring to the § 341 meeting of creditors a picture identification and evidence of social security number(s).2 Bankruptcy Rule 4002(b)(2)—without explicit statutory authority—requires every Chapter 13 debtor to bring to the meeting of creditors evidence of current income such as payment advices, bank account information and, under some circumstances, monthly expense information.3 Rule 4002(b)(3) and (4) describe complex debtor requirements with respect to providing tax returns to the trustee before the meeting of creditors and to creditors requesting those returns.4
