§ 140.5 — 11 U.S.C. § 349: Effects of Dismissal

Revised: September 28, 2009

Dismissal of the Chapter 13 case reinstates any transfers or liens that may have been avoided, vacates judgments for recovery of property from third parties and revests property of the Chapter 13 estate in the entities in which it was vested before commencement of the case. There is controversy about the meaning and availability of “dismissal with prejudice.”
