§ 155.1     11 U.S.C. § 523: Exceptions to Discharge

Section 1328 cross-references the nondischargeability of certain debts in § 523(a). Of particular importance in Chapter 13 practice are the exceptions for domestic support obligations in § 523(a)(5)1 and student loans in § 523(a)(8).2 All of the § 523(a) exceptions to discharge apply if the debtor seeks a discharge before completion of payments under the plan.3 Expansion of the exceptions to discharge in Chapter 13 cases by the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA)4 are discussed in detail in Part 9.
